DEAR CARRIE: I am a home-health administrator and have a question concerning an employee who's been out of work for almost seven months because of a serious illness. She has worked for our agency for 17 years and has accrued more than 100 days of sick leave. After all this time, she still has some sick days left. But the agency's insurance coordinator is claiming that we weren't responsible for insurance premiums after the first 12 weeks of her paid sick leave, which ran concurrently with time off under the Family and Medical Leave Act. Instead, the coordinator says the woman should have started making COBRA payments after 12 weeks. So the coordinator wants the woman to repay the agency for all the insurance premiums the company has paid on her behalf since the 12-week mark. But the woman is still employed with us, since she has not depleted her sick leave.
